I think you just go to the police.

sueing is for monetary claims (ex. he caused you sleepless nights and fear/anxiety, think court tv, judge joe brown, judge judy, etc), pressing charges actually put him in front of a judge to get a penalty (ex. oj simpson).

sueing is a civil case (you vs. him)
pressing charges is a criminal case (him vs. the state/gov't)

if you sue you get money as your reward. if you press charges the other person gets arrested, parol, fined, etc. as your reward. this is all of course if the other person is found guilty. can you even sue someone for assault? i think you would have to press charges for that unless they broke something or you had to go to the hospital. then you could sue for medical bills and for the physcological affects the assault had on you.

I would just press charges. You can sue someone over being assaulted, but you won't get much out of the case unless you have a bunch of medical bills. For me, I would just press charages so that person will get arrested, fine, court dates that you don't have to goto unless you want, etc. The assaulter may even owe you some money.
