My Car is Totaled!
I was in the middle of the intersection waiting to make a left turn. When the light turned yellowed I creeped a bit but someone ran that so I stopped completely and then it turned red. Oncoming traffic stop so I started to go. Then out of no where someone ran the red light and hit me. When I got out the car the guy said, "I live right here" (we were in hempstead, long island) and then ran away leaving his car. His car reaked of beer and there was a 24 pack of beer in his car and some of the cans were opened.
When the officer came I told him my story. I drew a blank and didn't know what to say. I told him the story and he's like "So you're telling me you ran a red light?" The cop was a total *** and made it my fault even though the guy ran and had beer in his car.
Later on that night when I got the police report he said it was my fault but he did include that the other driver fled the scene and did have open beer in his car. I pleaded with the officer that I did have the right of way but he refused to change his story. So luckily my dad is good friends with another officer so he is going to talk to this officer.
I don't have any pictures but the front is gone. I don't have a 240sx anymore and I'm sad. This was my first car, first accident and first lost :-(. Such a pain seeing my 240 on the tow-bed. Now my insurance is going to skyrocket and I'm 18 (It's under my name.) After this situation is fixed I'm going to look for another 240. I'm either looking for another white, maroon or black. White is my favorite for sure. I'm sad and I'll be emo for the next couple days. Cop was totally an ***

sucks sucks sucks...you kinda did run the light though even though others stopped for you and he ran a light as well both of you were in the wrong and he should be charged for a couple things but there is not much you can do about that now...good luck with everything
All I want to know is what I have to do next and what is going to happen. This is my first time with this occurring. I'm using my dads car to go to school so should I get insurance under that car until I get another one? What's going to happen next? Can someone PLEASE fill me in with the process? Thanks for the help guys; I really appreciate it. It really pisses me off that my first accident has to be with a drunk guy who lives over 30 minutes away from the accident.
your insurance may not go up at all. i have about 5 speeding tickets and a following too close resulting in a collision tickets and my rates never went up. i'm not proud of these tickets so don't get the wrong idea.
what you need to do is take the guy to court if you can to pay for the damages to your car. technically it sounds like you're at fault but if he was drunk and fled the scene you should be fine. you'll probably have to go to court over this but some judges are good people and throw out charges like that.
but if the officer didn't give you a ticket you don't have to do anything at all. if you do decide to sue the guy then you'll need the police report.

i agree. i also reccomend not dragging this out, and getting on top of getting an appraisal of how much it will cost to fix your car, or will the insurance total it? having as much as you can before your court date will help a lot. as far as insuring your dads car that you are driving, if it doesnt then yes, if not then get some liability. i have always just added the car to mine when its happened to me. but check prices bc my rates have always gone up

Thats where it stops. He didn't mention me being in the middle of the intersection or what color was the light. He didn't mention that the beer was in the other car. He just ended at MV#. Call ur insurance tell em what happend. It would of helped if u had a camera there on the accident to show the court or whoever (might wanna think about that incase this happens in the future.) I would reccommend getting a lawyer to, or atleast get in touch of one.
It could of been worse. A car is a car, you only got one life. Glad your alright.

I talked to my insurance company and another officer. I had the right of way. I didn't run the red light because I was already in the middle of the intersection waiting to make the left. When the oncoming traffic stopped thats when I went and the light was red. The other guy ran the light and hit me. He was at fault, not me. Now I'm going to the police station right now and telling them to amend the police report.
