1.) get a lawyer, he will get you more $ out of this than you could ever think possible from both your insurance company and that guy's. and at most, he will take... 20%?
2.) contact your insurance company and the other guy's.
3.) let your insurance pull an estimate and then let your lawyer handle it from there. Your estimate will go higher with an attorney in the mix, trust me.
4.) collect from your insurance company the money your attorney will milk from them.
5.) inform your attorney you want the car back as part of your "buy-back" option in your policy. All insurance policies have that option, it saves them $ from putting it on the auction block.
Or you can just contact your insruance company and let them handle the whole thing and let them know you want the car back regardless.
